Can a buyer in Canada purchase property in Mohali?
Yes. Under FEMA, NRIs and OCI cardholders in Canada can buy residential and commercial property in India, including GMADA Aerotropolis LOIs and developed plots. Agricultural land, plantations and farmhouses remain restricted.
How do I pay from Canada?
Funds are routed through an NRE or NRO account with an Indian bank and settled in INR. Keep the FIRC for every transfer from Canada for repatriation later. Payment in cash is not used.
Can I buy without flying to India?
Yes. A registered Power of Attorney, signed before the Indian mission in Canada and apostilled, lets a trusted representative complete registry and GMADA transfer on your behalf.
Will I be taxed twice between India and Canada?
India has a Double Taxation Avoidance Agreement with Canada. Capital gains are taxed in India and credited against your liability at home, so the same gain is not taxed twice.
Can an OCI holder in Canada buy property in India?
Yes. OCI cardholders have the same property rights as NRIs under FEMA: residential and commercial property, including GMADA LOIs and plots, with no limit on count. How do I make a power of attorney for India from Canada?
Canada joined the Hague Apostille Convention on 11 January 2024, so a PoA notarised and apostilled in Canada needs no further attestation by the Indian mission. Alternatively, sign it before the consulate via BLS. Send the original to India and register it at the Sub-Registrar.
Can I open an NRE account from Canada?
Yes. SBI Canada Bank and ICICI Bank Canada operate locally, and major Indian banks (SBI, HDFC, ICICI, Axis) open NRE/NRO accounts remotely with notarised KYC documents. No India visit is required.
