For years, families in Pancham Society in Mohali lived in flats they had paid for and still could not sell. GMADA had allotted the land under their buildings to the cooperative society behind the project. The society fell behind on the instalments it owed for that land, and GMADA took the allotment back. The flats stayed where they were. The ground under them had gone back to the authority.
So who owns the land under a flat in a Mohali tower? Under Punjab's apartment laws, the buyer ends up with the flat itself and an undivided share in the land and the common areas. That share is only as good as the title of the builder or society that sells it, and it becomes the buyer's only when it is conveyed. Until then the land sits with whoever GMADA allotted it to, on GMADA's terms. GMADA did take the land back at Pancham, and it came close at Beverly Golf Avenue, where it cancelled the builder's allotment with flats already built. In Zirakpur, the Opera Garden residents needed a regulator's order to get even the share in the common areas moved to their association.
What happened at Pancham Society
GMADA allotted the site to the Pancham Cooperative House Building Society, and the society built the flats. Members were given possession, but the society did not deposit the instalments of the land cost it owed GMADA. The Hindustan Times reported that members paid an extra amount demanded of them at possession and that the money never reached GMADA. GMADA put out a public notice to resume the land, and a group of members challenged it in the Punjab and Haryana High Court.
The way out came years later, and it came from GMADA. The authority agreed to recover the society's outstanding dues from the members themselves in proportionate shares and to execute conveyance deeds in their individual names. In February this year GMADA said it would take up sale deeds and other transfer cases in Pancham Society only for owners who had paid and held its no dues certificate. Members who had not paid are still treated as defaulters, and GMADA said it was sending them recovery notices.
What the Pancham families had bought, in practice, was the society's position on the land, with the society's debt attached to it.
What Punjab law says a flat owner holds
The Punjab Apartment Ownership Act gives a person to whom a promoter allots or sells a flat exclusive ownership and possession of that flat. With it comes an undivided interest in the common areas and facilities, in the percentage specified in the conveyance deed. The Act fixes that percentage by comparing the built up area of the flat with the built up area of all the flats in the building.
The Act's definition of common areas includes the land on which the building stands. It says the flat owners own the common areas in common. Neither the promoter nor the residents' association has any ownership right in them, and the association only manages them. The share cannot be separated from the flat. The common areas stay undivided, and no owner can sue to have them partitioned.
So the land under a tower is never a patch of ground with a boundary that one buyer can point to. A flat owner owns the flat and a fraction of everything else, the land included, held jointly with every other owner in the building. The fraction travels with the flat when it is sold or mortgaged and cannot be sold on its own.

The share arrives with the conveyance deed
That ownership does not begin with the booking or with the keys. The Punjab Apartment and Property Regulation Act sets the order. Once the occupation certificate is obtained, it says, the promoter "shall take all necessary steps to complete his title and convey the exclusive ownership of the apartment" along with "the undivided interest in the common areas and facilities appurtenant to such apartment". The conveyance deed is due within a fixed period of giving possession. If the promoter fails to do so without sufficient cause, the same Act lets the person in possession apply to the competent authority for a certificate, so the deed can be registered without the promoter's signature.
The Apartment Ownership Act says the same thing from the other side. Where the land is not leasehold, it is on the execution of the conveyance deed that the title of the flat and the share in the common areas are treated as passing to the owner. The central RERA Act likewise requires the promoter to execute a registered conveyance deed in favour of the allottee, and to pass the undivided proportionate title in the common areas to the association of allottees.
The words that matter are "complete his title". The law expects the seller to put its own title to the land in order before it can pass a share of that land to anyone. At Pancham, GMADA executed conveyance deeds only once the dues on the land were paid, so a society still owing GMADA for the site had no complete title to pass. Keys and years of residence did not change that.
Until then, the land answers to GMADA
GMADA sells sites in its sectors under the Punjab Regional and Town Planning and Development Act. Its resumption section says that where a transferee defaults on the price or on any instalment, the Estate Officer may first impose a penalty after notice. If the money is still not paid, or another condition of the transfer is broken, the Estate Officer may issue a show cause notice proposing to resume the land or building and forfeit part of the money paid. After a hearing, the Estate Officer may order resumption. An appeal lies to GMADA's Chief Administrator, and a revision after that to the state government.
The section speaks of the transferee. For a tower site that means the builder or society to which GMADA sold or allotted the land. A notice of resumption is addressed to them, and the land it covers is the land under every flat in the project.
Beverly Golf Avenue came close
Beverly Golf Avenue, the group housing project beside the Mohali golf range, had its allotment cancelled and restored within weeks. Its builder, MB Infra Build, had bought the site at auction, deposited part of the bid, received its allotment letter and then failed to pay the balance on schedule. By then it had already built flats on the site. GMADA cancelled the allotment, under the planning and development Act according to its officials, and put out a circular cautioning the public against any purchase or transaction in the project, saying it would not be responsible for such dealings. The Tribune reported that the default put the future of hundreds of flat owners in jeopardy.
The builder appealed to GMADA's appellate authority. Within a month, after it paid a part of the outstanding amount, GMADA withdrew the cancellation notice. The builder's side said a GMADA board outside the site warning the public against buying had been removed. The buyers had not caused the cancellation, and the withdrawal followed a payment by the builder.

Opera Garden shows the common areas need a formal handover
Opera Garden is at Kishanpura in Dhakoli, in Zirakpur, outside Mohali city though in the same district. The Opera Residents Association took the promoters to RERA Punjab over unfinished amenities and common areas that had not been handed over. In an order reported in August, RERA found that the promoters had obtained completion and occupancy certificates for only some of the towers and not for the whole project.
RERA directed the promoters to "transfer undivided proportionate rights in common areas and relevant documents" to the recognised residents' association. Two rival associations claimed to speak for the residents, so RERA sent both to the Sub Divisional Magistrate to establish which one is the recognised body. Until maintenance is lawfully handed over, the promoters have to keep essential services running. Allottees remain liable for maintenance charges under their agreements. That duty to keep paying maintenance is the subject of an earlier RERA order we covered.
Punjab's apartment law and the central RERA Act phrase the common area share differently. The state law says the owners hold it in common and the association only manages it. The RERA Act speaks of passing the undivided proportionate title in the common areas to the association. Either way, the share does not reach the residents' side until the promoter transfers it. At Opera Garden it took a complaint and an order to set that transfer going.
So who owns the land under the flat
Once the conveyance deed is executed, the flat owners do, together, each in the share the deed records, with nobody owning a marked piece of it. Before that, the land is held by the builder or society GMADA allotted it to, on the conditions of that allotment, payment of the price among them. The buyer holds an agreement and the promise of a share, and often possession too.
The law puts duties on the promoter around that gap. The Punjab Apartment and Property Regulation Act requires the promoter to disclose the nature of its title to the land and any encumbrance on it. The RERA Act makes the promoter compensate allottees for loss caused by a defect in the title to the project land. Both are claims against the promoter. What lifted GMADA's action in the two Mohali cases was money paid to GMADA: a part payment by the builder at Beverly Golf Avenue, and at Pancham, in the end, the flat owners' own shares of the society's dues.
What the record establishes
The Punjab statutes give a flat owner the flat and an undivided share in the land and common areas, and they tie that share to the conveyance deed. Until the deed, the land answers to GMADA through whoever it allotted the site to. GMADA's Act lets it resume land for unpaid dues. The two Mohali cases come at that rule from opposite ends. At Pancham the resumption went through with families already in their flats, and at Beverly Golf Avenue a cancellation was lifted after the builder paid part of what it owed. The Zirakpur case adds that the common area share can sit with a promoter until a regulator orders it across.

पंचम सोसाइटी में क्या हुआ
GMADA ने साइट पंचम कोऑपरेटिव हाउस बिल्डिंग सोसाइटी को आवंटित की, और सोसाइटी ने फ्लैट बनाए। सदस्यों को कब्जा दिया गया, लेकिन सोसाइटी ने GMADA को देय भूमि लागत की किस्तें जमा नहीं कीं। हिंदुस्तान टाइम्स ने रिपोर्ट किया कि सदस्यों ने कब्जे के समय उनसे मांगी गई अतिरिक्त राशि का भुगतान किया और वह पैसा GMADA तक कभी नहीं पहुँचा। GMADA ने जमीन वापस लेने के लिए एक सार्वजनिक नोटिस जारी किया, और सदस्यों के एक समूह ने पंजाब और हरियाणा उच्च न्यायालय में इसे चुनौती दी।
समाधान वर्षों बाद आया, और वह GMADA की ओर से आया। प्राधिकरण ने सोसाइटी के बकाया बकाये को सदस्यों से ही आनुपातिक हिस्सों में वसूल करने और उनके व्यक्तिगत नामों पर हस्तांतरण विलेख (conveyance deeds) निष्पादित करने पर सहमति व्यक्त की। इस वर्ष फरवरी में GMADA ने कहा कि वह पंचम सोसाइटी में बिक्री विलेख (sale deeds) और अन्य हस्तांतरण मामले केवल उन मालिकों के लिए लेगी जिन्होंने भुगतान किया है और उसका नो ड्यूज़ प्रमाणपत्र (no dues certificate) रखते हैं। जिन सदस्यों ने भुगतान नहीं किया है उन्हें अब भी चूककर्ता माना जाता है, और GMADA ने कहा कि वह उन्हें वसूली नोटिस भेज रहा है।
पंचम के परिवारों ने व्यवहार में जो खरीदा था, वह जमीन पर सोसाइटी की स्थिति थी, जिसके साथ सोसाइटी का कर्ज जुड़ा हुआ था।
पंजाब कानून कहता है कि फ्लैट मालिक के पास क्या होता है

अधिनियम की सामान्य क्षेत्रों की परिभाषा में वह जमीन शामिल है जिस पर इमारत खड़ी है। यह कहता है कि फ्लैट मालिक सामान्य क्षेत्रों के सामूहिक स्वामी हैं। न प्रोमोटर और न ही निवासी एसोसिएशन का उन पर कोई स्वामित्व अधिकार है, और एसोसिएशन केवल उनका प्रबंधन करती है। हिस्सा फ्लैट से अलग नहीं किया जा सकता। सामान्य क्षेत्र अविभाजित रहते हैं, और कोई भी मालिक उन्हें विभाजित कराने के लिए मुकदमा नहीं ला सकता।
इसलिए एक टावर के नीचे की जमीन कभी भी सीमा वाला भूमि का टुकड़ा नहीं होती जिसे कोई एक खरीदार इंगित कर सके। एक फ्लैट मालिक फ्लैट का और बाकी सब कुछ का, जमीन सहित, एक अंश का मालिक होता है, जो इमारत के हर अन्य मालिक के साथ संयुक्त रूप से धारित होता है। यह अंश फ्लैट के बिकने या बंधक रखे जाने पर उसके साथ चलता है और अकेले बेचा नहीं जा सकता।

हिस्सा हस्तांतरण विलेख के साथ आता है
वह स्वामित्व बुकिंग या चाबियों से शुरू नहीं होता। पंजाब अपार्टमेंट एंड प्रॉपर्टी रेगुलेशन एक्ट क्रम निर्धारित करता है। एक बार अधिभोग प्रमाणपत्र (occupation certificate) प्राप्त हो जाने के बाद, यह कहता है, प्रोमोटर "अपनी टाइटल पूरी करने और अपार्टमेंट का अनन्य स्वामित्व हस्तांतरित करने के लिए सभी आवश्यक कदम उठाएगा" साथ ही "ऐसे अपार्टमेंट से जुड़े सामान्य क्षेत्रों और सुविधाओं में अविभाजित हित" भी। कब्जा देने की एक निश्चित अवधि के भीतर हस्तांतरण विलेख देय होता है। यदि प्रोमोटर पर्याप्त कारण के बिना ऐसा करने में विफल रहता है, तो वही अधिनियम कब्जे में रहने वाले व्यक्ति को सक्षम प्राधिकरण से प्रमाणपत्र के लिए आवेदन करने की अनुमति देता है, ताकि विलेख प्रोमोटर के हस्ताक्षर के बिना पंजीकृत किया जा सके।
अपार्टमेंट ओनरशिप एक्ट दूसरी ओर से यही बात कहता है। जहाँ जमीन लीज़होल्ड नहीं है, वहाँ हस्तांतरण विलेख के निष्पादन पर ही फ्लैट की टाइटल और सामान्य क्षेत्रों में हिस्सा मालिक को हस्तांतरित माना जाता है। केंद्रीय RERA अधिनियम भी इसी प्रकार प्रोमोटर से आवंटी के पक्ष में एक पंजीकृत हस्तांतरण विलेख निष्पादित करने, और सामान्य क्षेत्रों में अविभाजित आनुपातिक टाइटल आवंटियों की एसोसिएशन को हस्तांतरित करने की अपेक्षा करता है।
महत्वपूर्ण शब्द हैं "अपनी टाइटल पूरी करना"। कानून अपेक्षा करता है कि विक्रेता किसी को भी उस जमीन का हिस्सा हस्तांतरित करने से पहले जमीन पर अपनी टाइटल को व्यवस्थित करे। पंचम में, GMADA ने हस्तांतरण विलेख तभी निष्पादित किए जब जमीन पर बकाया चुका दिया गया, इसलिए साइट के लिए GMADA को अभी भी बकाया रखने वाली सोसाइटी के पास हस्तांतरित करने के लिए कोई पूर्ण टाइटल नहीं थी। चाबियों और वर्षों के निवास ने इसे नहीं बदला।
तब तक, जमीन GMADA के अधीन है

यह अनुभाग हस्तांतरिती की बात करता है। एक टावर साइट के लिए इसका अर्थ है वह बिल्डर या सोसाइटी जिसे GMADA ने जमीन बेची या आवंटित की। पुनर्ग्रहण का नोटिस उन्हें संबोधित होता है, और जिस जमीन को वह कवर करता है वह परियोजना के हर फ्लैट के नीचे की जमीन है।
बेवर्ली गोल्फ एवेन्यू बहुत करीब आ गया
बेवर्ली गोल्फ एवेन्यू, मोहाली गोल्फ रेंज के बगल में समूह आवास परियोजना, का आवंटन कुछ सप्ताहों के भीतर रद्द और बहाल कर दिया गया। इसके बिल्डर, MB Infra Build, ने साइट नीलामी में खरीदी थी, बोली का एक हिस्सा जमा किया था, अपना आवंटन पत्र प्राप्त किया था और फिर निर्धारित समय पर शेष राशि का भुगतान करने में विफल रहा। तब तक यह साइट पर फ्लैट बना चुका था। GMADA ने आवंटन रद्द कर दिया, उसके अधिकारियों के अनुसार प्लानिंग एंड डेवलपमेंट एक्ट के तहत, और एक सर्कुलर जारी कर जनता को परियोजना में किसी भी खरीद या लेन-देन के विरुद्ध चेतावनी दी, यह कहते हुए कि वह ऐसे सौदों के लिए जिम्मेदार नहीं होगा। ट्रिब्यून ने रिपोर्ट किया कि इस चूक ने सैकड़ों फ्लैट मालिकों के भविष्य को खतरे में डाल दिया।
बिल्डर ने GMADA के अपीलीय प्राधिकरण में अपील की। एक महीने के भीतर, बकाया राशि का एक हिस्सा चुकाने के बाद, GMADA ने रद्दीकरण नोटिस वापस ले लिया। बिल्डर की ओर से कहा गया कि साइट के बाहर जनता को खरीदने के विरुद्ध चेतावनी देने वाला GMADA बोर्ड हटा दिया गया था। खरीदारों ने रद्दीकरण का कारण नहीं बना था, और वापसी बिल्डर द्वारा भुगतान के बाद हुई।
अधिभोग प्रमाणपत्र आने के बाद लागू RERA सुरक्षा उपायों पर निवासियों के बाद के विवाद को बेवर्ली गोल्फ एवेन्यू पर हमारी रिपोर्ट में शामिल किया गया है।
ओपेरा गार्डन दिखाता है कि सामान्य क्षेत्रों को औपचारिक हस्तांतरण की आवश्यकता है
ओपेरा गार्डन जीरकपुर के ढकोली में किशनपुरा में है, मोहाली शहर के बाहर लेकिन उसी जिले में। ओपेरा रेसिडेंट्स एसोसिएशन ने अधूरी सुविधाओं और हस्तांतरित न किए गए सामान्य क्षेत्रों को लेकर प्रोमोटरों के विरुद्ध RERA पंजाब में शिकायत दर्ज की। अगस्त में रिपोर्ट किए गए एक आदेश में, RERA ने पाया कि प्रोमोटरों ने केवल कुछ टावरों के लिए पूर्णता और अधिभोग प्रमाणपत्र प्राप्त किए थे, पूरी परियोजना के लिए नहीं।
RERA ने प्रोमोटरों को निर्देश दिया कि वे मान्यता प्राप्त निवासी एसोसिएशन को "सामान्य क्षेत्रों में अविभाजित आनुपातिक अधिकार और प्रासंगिक दस्तावेज हस्तांतरित करें"। दो प्रतिद्वंद्वी एसोसिएशनों ने निवासियों का प्रतिनिधित्व करने का दावा किया, इसलिए RERA ने दोनों को उपमंडलीय मजिस्ट्रेट के पास भेजा ताकि यह स्थापित हो सके कि मान्यता प्राप्त निकाय कौन है। जब तक रखरखाव विधिवत हस्तांतरित नहीं हो जाता, प्रोमोटरों को आवश्यक सेवाएँ चालू रखनी होंगी। आवंटी अपने समझौतों के तहत रखरखाव शुल्क के लिए उत्तरदायी बने रहते हैं। रखरखाव का भुगतान करते रहने का वह कर्तव्य हमारे कवर किए गए एक पूर्व RERA आदेश का विषय है।
पंजाब का अपार्टमेंट कानून और केंद्रीय RERA अधिनियम सामान्य क्षेत्र के हिस्से को अलग-अलग ढंग से व्यक्त करते हैं। राज्य कानून कहता है कि मालिक इसे सामूहिक रूप से धारित करते हैं और एसोसिएशन केवल इसका प्रबंधन करती है। RERA अधिनियम सामान्य क्षेत्रों में अविभाजित आनुपातिक टाइटल एसोसिएशन को हस्तांतरित करने की बात करता है। किसी भी तरह, जब तक प्रोमोटर इसे हस्तांतरित नहीं करता, हिस्सा निवासियों के पक्ष तक नहीं पहुँचता। ओपेरा गार्डन में उस हस्तांतरण को शुरू कराने के लिए एक शिकायत और एक आदेश की आवश्यकता पड़ी।
तो फ्लैट के नीचे की जमीन का मालिक कौन है
एक बार हस्तांतरण विलेख निष्पादित हो जाने के बाद, फ्लैट मालिक मिलकर, प्रत्येक उस हिस्से में जो विलेख दर्ज करता है, जिसमें कोई भी इसका चिह्नित टुकड़ा नहीं रखता। उससे पहले, जमीन उस बिल्डर या सोसाइटी के पास होती है जिसे GMADA ने आवंटित किया था, उस आवंटन की शर्तों पर, जिनमें मूल्य का भुगतान भी शामिल है। खरीदार के पास एक समझौता और एक हिस्से का वादा होता है, और अक्सर कब्जा भी।
