Since July, the Enforcement Directorate says it has emailed the Senior Superintendent of Police, Mohali, on five separate occasions, seeking information about the cheating of farmers ahead of the acquisition for Suntec City.
It says it received no response regarding the registration of new offences. So it has summoned him. Mohali SSP Varun Sharma has been called to the agency's Jalandhar office for 10 September.
A central investigating agency has spent two months asking a state police force to act on alleged offences against landowners, and has ended up calling in the district's police chief to ask in person. The SSP is being asked for information, not accused of anything. But of everything that has happened in this case this week, that summons is the only part that touches the fifteen people it started with.
At the top of the case
Anurag Verma, formerly Punjab's Chief Secretary and currently Additional Chief Secretary for Revenue, arrived at the same Jalandhar office at around 11.08 on the morning of 9 September, carrying a file of documents.
He had been summoned for 31 August, sought an adjournment to compile the documents the agency wanted, was issued fresh summons for 7 September, and those were rescheduled to Wednesday.
Verma was heading the Housing and Urban Development Department when the alleged irregularities took place. The Tribune reports his role is being examined to ascertain how violations of rules were allegedly allowed in the grant of change of land use and in layout modifications that allegedly benefited private builders.
Before him, IAS officer Kanwal Preet Brar was questioned twice, on 18 and 27 August, about the changes of land use and the layout modifications permitted in the project.
The probe covers two Mohali projects, Suntec City and Altus Space Builders Private Limited. The Tribune has also recorded that the policy in question was reversed in 2022, when Aman Arora, now the Aam Aadmi Party's Punjab president, was the Minister for Housing and Urban Development.
So the case has climbed. A society secretary arrested in May, a prosecution complaint in July alleging laundering of close to ₹348 crore, and now two senior civil servants questioned.
The base of it has not moved.
Who the farmers are
The ED's allegation, as we set out in our report on the CLU trail, is that fake consent letters were prepared covering 30.5 acres belonging to 15 landowners, bearing forged signatures and thumb impressions, and used to obtain the change of land use for the project. An FIR was registered at Mullanpur police station in November 2022 following complaints from landowners, invoking criminal conspiracy, cheating, forgery and the use of forged documents.
So there is an existing case. What the ED says it has been unable to get is the registration of new offences arising from what its own investigation has since turned up about the cheating of those farmers.
Everything above the ground level of this case has moved. Searches in May, an arrest, a prosecution complaint in July, and now two IAS officers questioned. At ground level, the position appears to be roughly where it was.
Why consent was the whole thing
The consent requirement reaches well beyond this one project.
A promoter seeking a change of land use over land it does not already own has to demonstrate that the landowners consented to the sale. That consent is the hinge of the application. It is how the state satisfies itself that the person asking to convert the land has a right to it. Forge it, and the permission underneath every subsequent approval was never validly obtained.
For the landowner, a signature or thumb impression is the entire defence. Our guide to the acquisition sections sets out the statutory ladder that runs alongside this, where the same principle applies at every stage: the state acts on documents, and the documents are assumed to be genuine until somebody proves otherwise. Proving otherwise is what these landowners have been attempting since 2022.
What the officials say
The Tribune's report today records that the officials concerned have maintained that they did not allow any violations and did not favour any builders.
Nothing in this case has been established against Verma, against Brar or against any other person named in connection with it. Summonses are an investigative step, a prosecution complaint is a charge rather than a finding, and the matter is live before the courts.
Two things worth watching
Whether the SSP's appearance produces the registration of new offences. That is the single item on which the landowners' position turns, and it is checkable within days rather than years.
And whether the layout side of the investigation moves. The ED is examining not only the change of land use but alleged unauthorised layout modifications, and has reportedly looked at an allegation that group housing sites were transferred to one construction firm after such a modification while a competing transfer application was rejected. That is a different mechanism from forged consent and it affects a different set of buyers.
This case has produced arrests, searches, a ₹348 crore prosecution complaint and the questioning of two senior civil servants. It began with fifteen people saying that signatures on a document were not theirs, and four years on, that is still the part waiting on somebody to act.

किसान कौन हैं

इस मामले के जमीनी स्तर के ऊपर सब कुछ आगे बढ़ गया है। मई में तलाशी, एक गिरफ्तारी, जुलाई में एक अभियोजन शिकायत, और अब दो IAS अधिकारियों से पूछताछ। जमीनी स्तर पर, स्थिति मोटे तौर पर वहीं दिखती है जहां वह थी।
सहमति ही सब कुछ क्यों थी
सहमति की आवश्यकता इस एक परियोजना से कहीं आगे तक फैली हुई है।
एक प्रमोटर जो उस भूमि पर भूमि उपयोग परिवर्तन चाहता है जो पहले से उसके स्वामित्व में नहीं है, उसे यह प्रदर्शित करना होता है कि भूमि मालिकों ने बिक्री के लिए सहमति दी थी। वह सहमति आवेदन की धुरी है। इसी तरह राज्य स्वयं को संतुष्ट करता है कि भूमि को परिवर्तित करने के लिए कहने वाले व्यक्ति का उस पर अधिकार है। इसे जाली बनाओ, और हर बाद की मंजूरी के नीचे की अनुमति कभी वैध रूप से प्राप्त ही नहीं हुई।
भूमि मालिक के लिए, एक हस्ताक्षर या अंगूठे का निशान ही पूरा बचाव है। हमारी अधिग्रहण धाराओं की मार्गदर्शिका उस वैधानिक सीढ़ी को बताती है जो इसके साथ-साथ चलती है, जहां हर चरण पर वही सिद्धांत लागू होता है: राज्य दस्तावेजों पर कार्रवाई करता है, और दस्तावेजों को तब तक असली माना जाता है जब तक कोई अन्यथा सिद्ध न कर दे। अन्यथा सिद्ध करना ही वह काम है जो ये भूमि मालिक 2022 से करने का प्रयास कर रहे हैं।
अधिकारी क्या कहते हैं
The Tribune की आज की रिपोर्ट दर्ज करती है कि संबंधित अधिकारियों ने बरकरार रखा है कि उन्होंने किसी भी उल्लंघन की अनुमति नहीं दी और किसी भी बिल्डर को लाभ नहीं पहुंचाया।
इस मामले में वर्मा के खिलाफ, बराड़ के खिलाफ या इससे संबंधित किसी अन्य नामित व्यक्ति के खिलाफ कुछ भी सिद्ध नहीं हुआ है। समन एक जांच कदम है, अभियोजन शिकायत एक आरोप है न कि निष्कर्ष, और मामला अदालतों के समक्ष विचाराधीन है।
दो बातें जिन पर नजर रखने योग्य है
क्या SSP की उपस्थिति से नए अपराधों का पंजीकरण होता है। यही एकमात्र मद है जिस पर भूमि मालिकों की स्थिति टिकी है, और इसे वर्षों के बजाय दिनों में जांचा जा सकता है।
और क्या जांच का लेआउट पक्ष आगे बढ़ता है। ED न केवल भूमि उपयोग परिवर्तन की जांच कर रहा है बल्कि कथित अनधिकृत लेआउट संशोधनों की भी, और कथित तौर पर एक आरोप को देखा है कि ऐसे संशोधन के बाद ग्रुप हाउसिंग साइटों को एक निर्माण फर्म को हस्तांतरित कर दिया गया जबकि एक प्रतिस्पर्धी हस्तांतरण आवेदन खारिज कर दिया गया। यह जाली सहमति से एक अलग तंत्र है और यह खरीदारों के एक अलग समूह को प्रभावित करता है।
इस मामले ने गिरफ्तारियां, तलाशी, ₹348 करोड़ की अभियोजन शिकायत और दो वरिष्ठ सिविल सेवकों से पूछताछ को जन्म दिया है। इसकी शुरुआत पंद्रह लोगों के यह कहने से हुई थी कि एक दस्तावेज पर हस्ताक्षर उनके नहीं हैं, और चार साल बाद, वही हिस्सा अब भी किसी के कार्रवाई करने का इंतजार कर रहा है।

ਇਸ ਲਈ ਇੱਕ ਮੌਜੂਦਾ ਕੇਸ ਹੈ। ED ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਉਹ ਉਹਨਾਂ ਨਵੇਂ ਅਪਰਾਧਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਨਹੀਂ ਕਰਵਾ ਸਕਿਆ ਜੋ ਉਸਦੀ ਆਪਣੀ ਜਾਂਚ ਤੋਂ ਬਾਅਦ ਉਹਨਾਂ ਕਿਸਾਨਾਂ ਨਾਲ ਹੋਈ ਧੋਖਾਧੜੀ ਬਾਰੇ ਸਾਹਮਣੇ ਆਏ ਹਨ।
ਇਸ ਕੇਸ ਦੇ ਜ਼ਮੀਨੀ ਪੱਧਰ ਤੋਂ ਉੱਪਰ ਸਭ ਕੁਝ ਹਿਲ ਗਿਆ ਹੈ। ਮਈ ਵਿੱਚ ਤਲਾਸ਼ੀਆਂ, ਇੱਕ ਗ੍ਰਿਫ਼ਤਾਰੀ, ਜੁਲਾਈ ਵਿੱਚ ਇੱਕ ਪ੍ਰੋਸੀਕਿਊਸ਼ਨ ਸ਼ਿਕਾਇਤ, ਅਤੇ ਹੁਣ ਦੋ IAS ਅਧਿਕਾਰੀਆਂ ਤੋਂ ਪੁੱਛਗਿੱਛ। ਜ਼ਮੀਨੀ ਪੱਧਰ 'ਤੇ, ਸਥਿਤੀ ਲਗਭਗ ਉੱਥੇ ਹੀ ਜਾਪਦੀ ਹੈ ਜਿੱਥੇ ਪਹਿਲਾਂ ਸੀ।

ਸਹਿਮਤੀ ਦੀ ਲੋੜ ਇਸ ਇੱਕ ਪ੍ਰੋਜੈਕਟ ਤੋਂ ਕਿਤੇ ਪਰੇ ਤੱਕ ਪਹੁੰਚਦੀ ਹੈ।
ਇੱਕ ਪ੍ਰੋਮੋਟਰ ਜੋ ਉਸ ਜ਼ਮੀਨ 'ਤੇ ਜ਼ਮੀਨ ਦੀ ਵਰਤੋਂ ਬਦਲਣਾ ਚਾਹੁੰਦਾ ਹੈ ਜੋ ਉਸਦੀ ਆਪਣੀ ਨਹੀਂ ਹੈ, ਉਸਨੂੰ ਇਹ ਦਰਸਾਉਣਾ ਪੈਂਦਾ ਹੈ ਕਿ ਜ਼ਮੀਨ ਮਾਲਕਾਂ ਨੇ ਵਿਕਰੀ ਲਈ ਸਹਿਮਤੀ ਦਿੱਤੀ ਸੀ। ਉਹ ਸਹਿਮਤੀ ਅਰਜ਼ੀ ਦਾ ਅਧਾਰ ਹੈ। ਇਹ ਇਸ ਤਰ੍ਹਾਂ ਹੈ ਕਿ ਰਾਜ ਆਪਣੇ ਆਪ ਨੂੰ ਸੰਤੁਸ਼ਟ ਕਰਦਾ ਹੈ ਕਿ ਜ਼ਮੀਨ ਨੂੰ ਬਦਲਣ ਲਈ ਕਹਿਣ ਵਾਲੇ ਵਿਅਕਤੀ ਦਾ ਉਸ 'ਤੇ ਹੱਕ ਹੈ। ਇਸਨੂੰ ਜਾਅਲੀ ਬਣਾਓ, ਅਤੇ ਹਰ ਬਾਅਦ ਵਾਲੀ ਮਨਜ਼ੂਰੀ ਦੇ ਹੇਠਾਂ ਇਜਾਜ਼ਤ ਕਦੇ ਵੀ ਵੈਧ ਢੰਗ ਨਾਲ ਪ੍ਰਾਪਤ ਨਹੀਂ ਕੀਤੀ ਗਈ ਸੀ।

ਅਧਿਕਾਰੀ ਕੀ ਕਹਿੰਦੇ ਹਨ
The Tribune ਦੀ ਅੱਜ ਦੀ ਰਿਪੋਰਟ ਦਰਜ ਕਰਦੀ ਹੈ ਕਿ ਸੰਬੰਧਿਤ ਅਧਿਕਾਰੀਆਂ ਨੇ ਕਾਇਮ ਰੱਖਿਆ ਹੈ ਕਿ ਉਹਨਾਂ ਨੇ ਕੋਈ ਉਲੰਘਣਾ ਨਹੀਂ ਹੋਣ ਦਿੱਤੀ ਅਤੇ ਕਿਸੇ ਬਿਲਡਰ ਦੀ ਪੱਖਪਾਤ ਨਹੀਂ ਕੀਤੀ।

ਕੀ SSP ਦੀ ਪੇਸ਼ੀ ਨਾਲ ਨਵੇਂ ਅਪਰਾਧਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਹੁੰਦੀ ਹੈ। ਇਹ ਇੱਕੋ ਇੱਕ ਮੁੱਦਾ ਹੈ ਜਿਸ 'ਤੇ ਜ਼ਮੀਨ ਮਾਲਕਾਂ ਦੀ ਸਥਿਤੀ ਨਿਰਭਰ ਕਰਦੀ ਹੈ, ਅਤੇ ਇਹ ਸਾਲਾਂ ਦੀ ਬਜਾਏ ਦਿਨਾਂ ਵਿੱਚ ਜਾਂਚਯੋਗ ਹੈ।
